Delhi Government is Thinking 39 IAS Officers Return to the Centre

New Delhi. Delhi CM fights between LG and notification by the central government has increased the controversy. केंद्र को 39 IAS अधिकारियों को लौटाने का मन बना रही है दिल्ली सरकार

नई दिल्ली. दिल्ली में एलजी और सीएम के झगड़े बीच केंद्र सरकार द्वारा नोटिफिकेशन से विवाद और बढ़ गया है। शुक्रवार को केंद्र सरकार ने अपने नोटिफिकेशन में एलजी को दिल्ली का शासन प्रमुख बताया था जिस पर केजरीवाल सरकार ने आपत्ति जताई है। इसके बाद ही दिल्ली सरकार ने 39 आईएएस अफसर केंद्र को लौटाने की तैयारी कर ली है।

सरकार की दलील है कि उसके पास जरूरत से ज्यादा आईएएस अधिकारी हैं और कुछ अधिकारियों को केंद्र को लौटाने से खजाने से बोझ कम होगा। बताया जा रहा है कि केजरीवाल सरकार आईएएस अफसरों पर निर्भरता कम कर दानिक्स (दिल्ली, अंडमान-निकोबार द्वीप समूह सिविल सेवा) अफसरों से काम लेगी। इस बाबत दानिक्स कैडर के तीन अधिकारियों की तैनाती भी हो गई है। गौरतलब है कि दिल्ली में अभी 83 आईएएस और लगभग 300 दानिक्स कैडर के अधिकारी कार्यरत हैं।

गोपाल सुब्रमणयम ने दी दिल्ली सरकार को सलाह

दिल्ली में उप राज्यपाल को सर्वेसर्वा बताने वाली केंद्र की अधिसूचना से नाराज़ दिल्ली सरकार क़ानून के जानकारों की सलाह ले रही है। इसी क्रम में पूर्व अटॉर्नी जनरल गोपाल सुब्रमण्यम राय की भी सलाह मांगी गई थी। सुब्रमण्यम ने गृह मंत्रालय के नोटिफिकेशन को असंवैधानिक और गैरकानूनी बताया है। उन्होंने सरकार को भेजी चिट्ठी में लिखा है, मुझे उम्मीद है कि ये नोटिफिकेशन राष्ट्रपति की अनुमति के बिना ही जारी हुआ है। ऐसे में ये असंवैधानिक है।

कल गृह मंत्रालय ने जारी किया था नोटिफिकेशन

गौरतलब है कि कल केंद्र सरकार द्वारा नोटिफिकेशन जारी कर एलजी नजीब जंग को शासन प्रमुख बताया गया है। गृह मंत्रालय की ओर से जारी नोटिफिकेशन में कहा गया है कि नियुक्ति व तबादलों में भी अंतिम फैसला एलजी ही करेंगे। बाकी मामलों में भी वह सीएम की सलाह लेने के लिए मजबूर नहीं हैं। दिल्ली का उपराज्यपाल लोक व्यवस्था, पुलिस, भूमि और सेवाओं से संबंधित विषयों में ट्रांसफर और पोस्टिंग की शक्तियां रखता है। ऐसा वह राष्ट्रपति द्वारा प्रदान की गई शक्तियों और कृत्यों के निर्वहन के आधार पर करेंगे। अन्य सेवाओं के विषय में वह चाहें तो दिल्ली के मुख्यमंत्री से विचार-विमर्श के आधार पर निर्णय ले सकता है।

सीएम ने साधा केंद्र सरकार पर निशाना

इस नोटिफिकेशन के जारी होने के कुछ ही घंटे के बाद मुख्यमंत्री अरविन्द केजरीवाल ने एक प्रेस कॉन्फ्रेंस कर के कहा कि यह उनकी सरकार के भ्रष्टाचार रोधी प्रयासों को लेकर बीजेपी और केन्द्र सरकार की घबराहट को जाहिर करता है। मुख्यमंत्री ने आरोप लगाया कि जंग तो महज एक चेहरा हैं और उन्हें आदेश पीएमओ से मिल रहे हैं। ‘आजादी के पहले इंग्‍लैंड की महारानी यहां वायसराय को अधिसूचना भेजा करती थीं। अब जंग साहब वायसराय हैं और पीएमओ लंदन है।’ उन्होंने कहा कि आम आदमी पार्टी सरकार अधिसूचना पर संविधान विशेषज्ञों से राय ले रही है और उसी के अनुरूप निर्णय लिया जाएगा।
